ENVIRONMENT AGREEMENT No 13, dated 30.03.2001

Further to the application submitted by the Institute for Railway Studies and Designs - S.A., registered by the Ministry of Waters and Environment Protection under no 105116/15.03.2001, further to the review and checking of the submitted documents,
Pursuant to the Law no 137/1995 on environment protection, republished, Based on the Government Decision no 17/2001 on the organization and functioning of the Ministry of Waters and Environment Protection, it is issued this:
AGREEMENT concerning the execution of rehabilitation works on BUCHAREST - CONSTANTA RAILWAY LINE making part of the pan-European Transport Corridor no IV,
aiming to provide better and safer traffic conditions_by means of increase of safety, traffic speed and reduction of the current travel time,
aiming to ensure a fluent traffic towards the ports, major trading zones, leisure and tourist and historical areas,
under the following terms:
- in the field of water quality protection   1. all discharge water shall be collected, drained and discharged (pluvial and waste waters) in decanting vessels and oil products separators so as to comply with the limits imposed by NTPA 001/97 for direct discharge in effluent drains and by NTPA 002/97 for overflow in sewerage system as well as the limits provided for under ST AS 4706/88 on the quality conditions for the 3rd category of use; 2. the limits imposed by NTPA 002/97 for the overflow in the sewerage system in case of waste water discharge from the stations on route;
3. increased capacity overflow systems shall be located in the immediate neighborhood of valley crossings in order to be able to collect discharges from the railway track in the area of crossing, in case of possible accidental pollution;
4. filter and phyto- purging retention basins shall be located before the overflow in crossed receivers;
5. the perturbation of natural water discharge during the execution and operation of said objective shall be avoided;
6. any modifications of water course dynamics and morphology further to the carried out works shall be avoided;
7. the danger of underground water pollution shall be eliminated by means of avoiding the loss of potential pollutant materials and substances;
8. service contracts shall be concluded with specialized units settling water use and discharge.
- in the field of air quality protection
1. the limits imposed by STAS 12574/87 on the air quality conditions in protected area shall be complied with;
2. measures to reduce the powder pollution based on an adequate transport and handling of construction materials and excavated materials during the works performance.
- in the field of soil quality protection
1 . construction materials shall be managed only within the work area, without affecting neighborhood, on arranged platforms provided with perimeter ~..~ protection ditch;
2. the necessary surface of work area shall not be exceeded;
3. vertical systematization of the railway line on slopes and drains shall be carried out so as to ensure pluvial water course towards pluvial water collection and directing drain along the railway track;
4. avoidance of soil settlement and destruction;
5. lands temporarily occupied shall be rehabilitated;
6. equipment and transport means shall be maintained and operated in an adequate technical condition so as to eliminate oil, fuel discharges and pollutant emission above the admissible values;
 7. the wastes of any kind shall be stored in specially provided areas for such purpose; 8. it is forbidden to store the materials on access roads or in areas that do not belong to the working area;
9. service contracts shall be concluded with specialized units aiming to ensure the wastes elimination, processing and final storage;
10. the unguarded storage of wastes is forbidden;
11 . the technological wastes shall be selectively collected in arranged areas aiming to ensure valuation of re-usable wastes in specialized units for such valuation and unloading in waste storage places in the area of the wastes that cannot be recycled and also of domestic wastes;
- in the field of bio-diversity protection and preservation
1 . valley section crossed by bridges shall be provided with original bushes and tree species, on a compact strip with the minimum width adequate to the safety area of the public railway infrastructure;
2. the access to the other crossed sections shall be provided with original herbaceous species;
3. the safety area of the public railway infrastructure shall be provided with compact strips of original tree species, especially on sections between the road infrastructure and the railway line as well as in forestry vegetation areas that are crossed by the railway line;
4. the damaged areas shall be renewed on works completion;
- in the field of human dwelling protection
1. discomfort factors shall be eliminated (dust, must, noise, vibration) during the period of work execution;
2. noise retaining panels and especially compact strips of original tree species shall be located in the safety area of the public railway infrastructure in the crossing sections to various localities;
3. the limits imposed by STAS 10009/88 referring to noise pollution;
4. a working schedule shall be set up so as to reach a minimum lack of comfort for the residents in the area;
5. protection works against electro-magnetic perturbation shall be carried out.
6. perturbation of normal traffic during the period of execution shall be avoided.

The environment agreement is issued under the following terms:
1. The legal provisions in force in relation to environment and water protection shall be complied with.
2. The statements in the technical specification shall be strictly complied with.
3. Recommendations included in the report on the study on impact shall be complied with.
4. The conditions included in documents of endorsement issued by other authorities shall be met.
5. Standards and norms in force to ensure the exigencies on construction quality shall be complied with.
6. Accidental pollution events shall be immediately communicated to County Environment Protection Offices in the relevant areas.
7. Preliminary acceptance shall be performed in the presence of representatives of County Environment Protection Offices in the relevant areas.
8. An environment agreement shall be requested from County Environment Protection Offices for each site organization.
9. An environment license shall be compulsorily requested from the County Environment Protection Offices in Bucharest, Ilfov, Calarasi, lalomita and Constanta.
The agreement for the execution of rehabilitation works on Bucharest -
Constanta railway line contains 5 pages and is valid for a period of 5 years from the date of issue.
Failure to totally comply with the provisions under this agreement shall cause its cancellation.
